RELEASE OF LIABILITY FOR PARTICIPANTS IN KATY – FULSHEAR (TX) ALUMNI CHAPTER GUIDE RIGHT/KAPPA LEAGUE PROGRAM
(PLEASE READ CAREFULLY BEFORE SIGNING)

I, the Parent/Guardian hereby acknowledge that I freely and voluntarily permit my child to participate in Katy - Fulshear (TX) Alumni Chapter’s Guide Right/Kappa League program (“Guide Right/Kappa League”), during the duration of the program to be specified during the orientation in (the “Program”).

I understand that participation in the Program is completely voluntary; that my child is under no obligation to take part in the Program; that the Program is provided through GUIDE RIGHT/KAPPA LEAGUE to enhance my child’s educational experience; and that NO INSURANCE COVERAGE MAY EXIST THROUGH GUIDE RIGHT/KAPPA LEAGUE TO COVER ANY CLAIMS THAT MAY ARISE OUT OF MY CHILD’S PARTICIPATION IN THE PROGRAM.

In consideration for GUIDE RIGHT/KAPPA LEAGUE’s arranging this opportunity for my child to participate in the Program and enhancing my child’s educational and/or competitive experience, I have fully read this Release of Liability (“Release”) and hereby execute this Release with the intent to bind myself, my spouse (if applicable), my heirs, assigns, and legal representatives. I further represent that I am at least eighteen (18) years of age and competent to sign this Release.

I understand that on some occasions, my child must arrange his own transportation related to the Program, and/or on some occasions, GUIDE RIGHT/KAPPA LEAGUE may arrange transportation. I further understand and agree that my child’s decision to accept transportation from GUIDE RIGHT/KAPPA LEAGUE is completely voluntary and accepted at his own risk that he is not required to accept such transportation and that such transportation will not be covered by any GUIDE RIGHT/KAPPA LEAGUE insurance. I understand that if my child chooses to take his own automobile, he must provide his own automobile collision and liability insurance. I also understand that if my child accepts transportation offered to him/her by another Program participant and/or GUIDE RIGHT/KAPPA LEAGUE members driving his own automobile, my child accepts such transportation at his own risk. I understand and agree that whatever alternate mode of transportation he may choose will not be covered by any insurance policy owned by GUIDE RIGHT/KAPPA LEAGUE.

I fully understand and acknowledge that certain elements of the Program may be physically and emotionally demanding and that by my child’s participation in the Program, he faces risks of accidental and/or other physical and/or emotional injuries. These risks may include, but are not limited to, (1) loss or damage to personal property; (2) physical or emotional injury or fatality due to, and/or related to, (a) all modes of travel while participating in the Program, whether by airline, automobile, train, boat, trolley, taxi, bus, public transportation or walking, (b) the condition of facilities which may or may not be under the control and maintenance of GUIDE RIGHT/KAPPA LEAGUE, (c) exposure to inclement weather, outdoor terrain, and all the risks inherent therein, including but not limited to: sunburn, heat exhaustion, insect bites/allergies, dust, dirt, etc., as well as any and all injuries, whatsoever, which may be sustained from activities of the Program, including, but not limited to, walking, running, jumping, swimming, bending, standing for extended periods of time, lifting small amounts of weight, handling athletic/activity equipment, being exposed to others handling athletic/activity equipment, colliding with other participants, and slips and falls; these injuries include, but are not limited to, scratches, lacerations, contusions, bruises, cuts, abrasions, muscle sprains, back injuries, soreness, concussions, broken bones, and (d) any and all other aspects and stress related to the Program, including interaction with personnel who are not members of GUIDE RIGHT/KAPPA LEAGUE, and (e) suffering any type of injury, illness, or infectious disease without immediate access to medical facilities.

I expressly affirm that I am aware of the Centers of Disease Control and Prevention (“CDC”) directives recommending social isolation and distancing in response to the COVID-19 pandemic. I am aware that GUIDE RIGHT/KAPPA LEAGUE cannot prevent the possibility of my child’s exposure to COVID-19 at the Program or during my transportation to and from the Program location. I understand that my child participating in Program involves risk of exposure to Program coordinators and other Program participants who may be infected with COVID-19. I am aware of and affirm the potential health risks that may occur if my child is exposed to COVID-19, up to and including death, and that my child’s exposure brings with it the possibility of exposing others, including members of my household and other communities. I acknowledge and am aware of CDC and other public health recommendations concerning the risks COVID-19 presents to individuals in certain age groups and/or with high-risk health conditions. I understand and voluntarily choose to allow my child to assume the risks of his participation in the Program and hereby represent that he can participate in this Program, with or without reasonable accommodations. I further acknowledge that my child has asked for and has received reasonable accommodations for any disability my child may have brought to the attention of the Program coordinators, having first presented a valid certification of his disability. My child and/or I agree to advise the Program coordinators at any point when my child questions his ability to participate in any activity of the Program.

I EXPRESSLY AGREE AND INTEND THAT MY CHILD’S PARTICIPATION IN THE PROGRAM SHALL BE UNDERTAKEN BY MY CHILD AT HIS OWN RISK AND THAT NEITHER GUIDE RIGHT/KAPPA LEAGUE, ITS TRUSTEES, OFFICERS, MEMBERS, AGENTS, VOLUNTEERS, NOR ASSIGNS SHALL BE LIABLE FOR ANY INJURIES, DAMAGES, CLAIMS, DEMANDS, ACTIONS OR CAUSES OF ACTION WHATSOEVER WHICH MAY ARISE OUT OF OR IN CONNECTION WITH MY CHILD’S PARTICIPATION IN THE PROGRAM, WHETHER FROM ACTS OF ACTIVE OR PASSIVE NEGLIGENCE ON THE PART OF MY CHILD AND/OR ON THE PART OF GUIDE RIGHT/KAPPA LEAGUE, ITS OFFICERS, MEMBERS, AGENTS, VOLUNTEERS, OR ASSIGNS, AND I, FOR MYSELF, MY HEIRS, PERSONAL REPRESENTATIVES OR ASSIGNS, DO HEREBY FOREVER RELEASE, DISCHARGE, INDEMNIFY, AND HOLD HARMLESS ITS OFFICERS, AGENTS, VOLUNTEERS, AND/OR ASSINGS FOR ANY CLAIMS, CAUSES OF ACTIONS, DEMANDS, EXPENSES, JUDGMENTS, FEES AND COSTS WHATSOEVER ARISING FROM OR IN CONNECTION WITH MY CHILD PARTICIPATING IN THE PROGRAM; AND WILL DEFEND GUIDE RIGHT/KAPPA LEAGUE, ITS OFFICERS, MEMBERS, AGENTS, VOLUNTEERS, AND/OR ASSIGNS FOR ANY SUCH INJURIES, DAMAGES, CLAIMS, DEMANDS, ACTIONS, OR CAUSES OF ACTION.

The terms of this Release are to be governed by and construed under the laws of the State of Texas. In the event any term or provision of this Release is found to be unenforceable or void, in whole or in part, the term or provision concerned shall be construed as valid and enforceable to the maximum extent permitted by law, and the balance of this Release shall remain in full force and effect.

I agree that the exclusive venue for any dispute arising between GUIDE RIGHT/KAPPA LEAGUE and I involving this Release in any way shall be in the state of Texas. I hereby acknowledge that I freely grant GUIDE RIGHT/KAPPA LEAGUE and its agents or members the right and permission to photograph/video and publish at any time in the future photos, videos, or other media that contains my child’s likeness, in whole or in part and with or without my name for GUIDE RIGHT/KAPPA LEAGUE-related editorial, promotional, educational, advertising, or trade purposes. I nor my child will make no monetary or other claims against GUIDE RIGHT/KAPPA LEAGUE and its agents or employees for the use of the photograph(s)/video(s).

Electronic Signature Consent

I expressly affirm that I intend for any use of a keypad, mouse, or other devices to type my name below (“E-signature”) to be the legal equivalent of a manual hand-written signature for purposes of validity, enforceability, and admissibility. I agree that no additional authority or third-party verification is necessary to validate my E-Signature and the lack of such verification will not in any way affect the enforceability of my E-Signature as pertaining to this Release.

I, agree and understand that by signing, all electronic signatures are the legal equivalent of my manual/handwritten signature and I consent to be legally bound to this agreement. I further agree my signature on this document is as valid as if I signed the document in writing. Under penalty of perjury, I herewith affirm that my electronic signature was signed by myself with full knowledge and consent, and am legally bound to these terms and conditions.
